Do You Have to Go to the Doctor for a Slip and Fall Accident?

Dolores Rice

If you've been injured in a slip and fall accident, you may be wondering whether you need to go to a doctor. The answer is probably yes. Here's why.

Why Else Would You Sue?

If you don't need to go to a doctor, why else would you need to sue for a slip and fall accident? In a slip and fall claim, you can be compensated for your medical bills, lost wages as a result of your inability to work, and related expenses. You can't sue for embarrassment alone. So if you come away from your slip and fall perfectly healthy and don't need to go to a doctor, you probably don't have a case.

You Need to Document When Your Injury Happened

A possible defense to your slip and fall claim can be that you didn't get hurt when you slipped and fell but at some other time. For example, maybe you slipped on a wet floor in a business on Tuesday and then fell off of a ladder cleaning your gutters at home on Saturday which is when you really got hurt. Maybe you wouldn't try to bring a false claim, but many other people have.

Going to the doctor right away gives you documentation of when your injury happened and when you sought treatment. If you wait days or weeks, the defense can argue that you must have gotten hurt somewhere else if you waited that long to go to a doctor.

Injuries Can Take Time to Develop

Soft tissue and other injuries can take time for you to feel and realize that there's something wrong. This puts you in the same problem above since by the time you realize you need to see a doctor, the defense could argue you got hurt doing something else. If you get checked out right away after a hard fall, the doctor may be able to spot something you can't feel yet and better tie it to your injury case.

Your Doctor Will Need to Testify

In most cases, you'll need a doctor to testify as to what your injuries were and that they came from a slip and fall not some other type of accident. Your medical bills prove how much you spent, but they often don't tell enough about why you needed that treatment to be the only proof that you can bring to court.
